[A] Carlisle man has appeared before District Judge Gerald Chalk by video-link today (Thurs).
Mark Nicholas Day, 56, was remanded in custody earlier this month after he pleaded guilty to a breach of a restraining order.
Carlisle magistrates court was told he failed to leave the Cumberland Infirmary, Carlisle after treatment on December 7.
The court was told Day, had been “assessed” by medical staff, but he refused to leave the hospital, police officers were called and he still refused to leave after numerous requests for him to leave were made, he was then arrested.
He was in breach of a criminal behaviour order imposed by a court on October 6, 2017, in that when he attends the hospital for treatment, he must leave when instructed to do so by staff or police officers, so he breached this court order.
He has no-permanent address at this time the court was told.
The judge imposed a Community Order in that Day must complete 50-days of unpaid work, when released from prison he will be under the supervision of the Probation Service for one-year, he has to pay a victims surcharge of £115.
The judge said, this offence crossed the custody threshold, because of his conduct at the hospital where vulnerable persons were present and staff working there.
Day was told he will be released from prison in a short while, as he has served time already on remand. He was in prison over the Christmas period.
