
A Carlisle man found to be more than three times the drink-drive limit while travelling without insurance has been spared an immediate prison sentence.
Juozas Cuzauskas, 29, came to the attention of a police officer on Eastern Way in the city at around 8pm on February 25.
Cuzauskas was at the wheel of a white Mercedes Vito van which was seen to collide with the kerb or verge several time for no apparent reason, Carlisle Magistrates’ Court heard.
The police officer turned their vehicle around and stopped the van. Cuzauskas provided a positive roadside breath test. The lower of two further readings showed 128 micrograms of alcohol in 100 millilitres of breath. The limit is 35ml.
In court, Cuzauskas, of Eldon Drive, admitted driving with excess alcohol, without insurance and otherwise than in accordance with his licence.
He accepted full responsibility for what he had done, and had no previous convictions.
Before Cuzauskas was sentenced, he was interviewed by a probation officer who told the court he had been going to see his poorly daughter at the time of the offence.
Magistrates suspended a 12-week prison sentence for a year. Cuzauskas was ordered to complete 200 hours’ unpaid work and disqualified from driving for 33 months.
This ban will be reduced by 33 weeks if he completes a drink-drive rehabilitation course he has been offered by the court.
