
Two Kendal men and a youth accused of serious alleged violent and sexual assaults on a male who was found badly hurt in the town are to stand trial early next year.
Christopher Calvert, aged 43, John Calvert, 35, and a 17-year-old youth all appeared in the dock at Carlisle Crown Court this morning.
The three defendants each face three charges. One of these alleges that they falsely imprisoned a male; a second alleges that they unlawfully and maliciously caused the male grievous bodily harm with intent to do so; and a third alleges assault by penetration — the circumstances being that “the penetration was sexual”, according to court papers, and allegedly involved the use of an object.
All charges relate to alleged incidents on June 2 this year.
A Cumbria police spokesman confirmed last month that officers had been called at 3.25pm on that date to Sandes Avenue in Kendal after a man was found with serious injuries in the street.
That man was taken by air ambulance to hospital in Preston where he was said, at the time, to be in a serious but stable condition.
During today’s short crown court hearing, John Calvert and the youth entered not guilty pleas to each of the three charges they face.
Not guilty pleas were entered on behalf of Calvert to the three allegations.
A timetable for the progression of the case was outlined by Richard Haworth, for the prosecution.
A date for a trial in front of a jury was fixed and this is due to start at the crown court on February 14, 2022.
It is estimated this hearing will last five to seven days.
In the meantime, John Calvert, of Stricklandgate, and Christopher Calvert, of Aikrigg, both Kendal, were remanded in custody by the judge, Recorder Kate Bex QC, who granted bail to the youth.
