
A troubled man who told a judge “you will never see me in this court again” is back in trouble within six months of making that promise — for prohibited possession of both a firearm and ammunition.
Scott Foster, 31, was spared prison in October as he was punished for offences that included assaulting his partner in the street and dangerous driving after a police pursuit in the aftermath of his violence.
Foster’s barrister had informed the sentencing judge at Carlisle Crown Court that he was affected by a brain injury. She also suggested there would be a “damaging effect” on his general rehabilitation for issues including substance misuse if he was sent to custody.
Announcing he was faced with a “stark choice”, with Foster also subject to a suspended jail term at the time, the judge stepped back from custody and instead imposed a community order.
But he warned the defendant “there will not be chance number three”. As he left the building, Foster stated: “You will never see me in this court again, trust me.”
But Foster was back at the crown court today when he pleaded guilty to three new offences. He admitted possessing both a firearm and ammunition when prohibited.
Having received the suspended prison sentence, in February 2020, he was banned from being in possession of both an air rifle and Webley 0.177 calibre pellets which were found, for a period of five years.
During today’s hearing Foster, of Mountain View, Harrington, further admitted the illegal possession of a class C drug, diazepam. His three latest crimes were committed on February 3 this year.
Judge Nicholas Barker adjourned the case. A prosecutor asked for time to seek more details about the circumstances of Foster’s latest offending, while his barrister will request additional background information relating to his brain injury.
Foster is due to be sentenced at the crown court next Friday. In the meantime, he was remanded in custody by Judge Barker.
