A Workington man once locked up for having lunch at his mum’s house on Boxing Day has been jailed for making yet another prohibited visit to see her.
Carlisle Crown Court heard a “chaotic lifestyle” over the past six years had led to repeat offending by 36-year-old James Walter MacDonald.
It was in March 2018, that MacDonald was handed a restraining order, initially to run for two years, amid concerns about his conduct. This order was later extended by a year and prevented him from visiting West View Walk in Workington — his mum’s home.
During 2018 he flouted the order three times before a fourth breach on Boxing Day when he went to the property and another member of the family called police.
Further breaches followed and two more were committed during the night of September 11 this year.
Just before midnight, MacDonald attended and asked to use a phone. But, when told he couldn’t, he hurled an ashtray at a double glazed kitchen window, breaking the outer pane. He left but returned at 2.30am and smashed a separate pane having asked for keys and a blanket.
MacDonald was arrested, brought to court and admitted two restraining order breaches, plus criminal damage.
Anthony Parkinson, defending, spoke of the defendant’s chaotic lifestyle during the and previous personal issues.
After hearing submissions, Judge Richard Archer told Macdonald, of no fixed address: “Your circumstances are very sad ones for everybody.” Judge Archer imposed an immediate 15-month prison sentence and made a fresh restraining order to run indefinitely.
