A man who failed to clean up after his dog in Penrith has been ordered to pay £400.

In a prosecution brought by Eden District Council, Kelvin Hughes of Latrigg Close, Keswick was charged with failing to remove faeces left by his Staffordshire Bull Terrier-type dog in St Andrews Churchyard, Penrith on March 28.

Hughes was initially offered the opportunity to pay a fixed penalty fee of £75, rather than have the matter dealt with by the courts, but declined and failed to pay within the allotted time.

Hughes did not attend Carlisle Magistrates Court and the case was proved in his absence. Magistrates fined him £220 and ordered him to pay a £30 victim surcharge and £150 court costs.

Senior Community Warden Karen Holmes said the case had been the fifth fixed penalty notice for dog fouling issued by Eden District Council in the last 12 months, adding: “Our aim make sure Eden is as clean and safe as possible, for everyone to enjoy. This case should serve as a reminder that dog fouling will not be tolerated and we are prepared to pursue the matter through the courts if necessary.”
