
A RECENTLY-qualified driver is set to have her licence revoked after being caught behind the wheel of a vehicle over the cannabis limit in South Cumbria.
Police attended a pub car park at Canal Foot, Ulverston, on January 24, finding 23-year-old Emma Jane Devlin in the driver’s seat of a Vauxhall Corsa.
A smell of cannabis was detected, and Devlin provided both a road side test and a blood sample, which revealed she was over the legal drug-drive limit.
Devlin, of Anson Street, Barrow-in-Furness, admitted being in charge of a vehicle while over the specified limit when she appeared before District Judge Gerald Chalk, sitting at Carlisle, this morning (FRI).
A defence lawyer said that Devlin had taken a “couple of smokes of her friend’s cannabis”, “hadn’t intended to smoke any more” and given an “extremely low” reading.
Devlin – a carer for her father, whom she visited regularly – was represented in court by a defence solicitor, who said she was aware she faced a minimum of 10 penalty points for the offence: “She is a probationary driver. They would revoke her licence and she would have to re-take her test. Tests are not being re-taken at the moment,” said the lawyer, who asked for her to be given a short driving ban instead of points.
But District Judge Chalk imposed 10 penalty points, along with a £120 fine, costs and surcharge, telling Devlin: “As I understand it, that is likely to result in the DVLA revolving your licence.”
