Penrith man assaulted wife after she began divorce proceedings

A district judge has asked for help from the probation service before the sentencing of a Penrith man for assaulting his wife and damaging her phone.

Carlisle Magistrates’ Court heard 33-year-old Dominic Bitcon’s criminal conduct occurred after his partner started divorce proceedings.

On July 20 he slapped her wrist at their home after she refused a hug. He placed his hands around her throat, squeezed and forced her back against a wall.

Bitcon started slamming her into the wall while holding her neck, kicked a falling water bottle which hit her shin, and then threw her phone on to a tiled floor and against a kitchen counter.

Police were alerted to his offending by a female member of the public who saw him stood in front of her car, at 8am, when he had been gesturing and “shouting aggressively” at her.

Ten days later, she and her new partner were woken at 5-30am by a loud bang, Bitcon having damaged the man’s Ford Fiesta with a wine bottle.

Bitcon, now of Greystoke Park Avenue, admitted assault and two criminal damage charges in court today (fri).

District Judge John Temperley adjourned the case, telling Bitcon: “These are serious matters and I need help from the probation service before deciding how to sentence you.”

Bitcon was granted conditional bail and is due to be punished on 9th September.
