A Carlisle woman has been banned from entering a host of city shops — but will be allowed to visit Primark after a judge granted her special request.
Lavinia Moorhead, 47, was sentenced at the city’s magistrates’ court last month for three offences.
Moorhead had used threatening, abusive or insulting words or behaviour towards a woman in Carlisle on June 5.
On September 5, she had stolen £47.50 worth of groceries and alcohol from a Tesco Express in the city and, several days later, had failed to surrender to custody at the court.
Moorhead, c/o Stanhope Road, Carlisle, was handed a prison sentence totalling 14 weeks.
An application was also made at that time by Cumbria police for the granting of a criminal behaviour order due to her persistent anti-social or criminal conduct, and proposed that she be banned from entering a host of city shops.
The case was adjourned for consideration of a request by Moorhead that she be allowed entry to the Primark store.
Moorhead was back in court today.
Prosecutor Diane Jackson said a police officer dealing with th application had considered the matter and was content that Moorhead should be permitted to enter Primark as an exception.
District judge Philip Holden formally made the order, which will remain in force for two years.
He was satisfied Moorhead had engaged in behaviour that had caused — or was likely to cause — harassment, alarm or distress in the past; and was likely to in the future. He was further satisfied that the CBO would prevent her from engaging in such behaviour in the future.
Moorhead is banned from:
All premises part of the Carlisle Shopwatch scheme.
Any Heron Foods outlet
Spar, English Street, Carlisle
Defence solicitor Lauren Heasley said Moorhead understood the order would last for two years, adding: “If she breaches, it can be extended.”
The district judge accepted Moorhead had to feed and clothe herself, but warned her: “If you breach this order you will be committing a criminal offence.”
