[A] SEX offender locked up for breaching notification requirements has had his sentence reduced.
Carlisle Crown Court heard Stuart Brierley, 37, was sentenced in November, 2010, for illegal “image-related offences”.
As part of his punishment he was ordered to sign the Sex Offenders’ Register for seven years. He was obliged to provide police with weekly updates about his living arrangements.
But earlier this month Brierley, of no fixed abode, admitted flouting the requirement twice. No notification was given to police in one case; in respect of the other offence, he failed to declare he had stayed at a Carlisle address for more than seven nights inside a single calendar year.
He was given 12 weeks in prison for each of the two offences and ordered to serve the terms consecutively.
His appeal against the punishment was heard at the crown court today (THURS). Having heard evidence in the case and mitigation, Judge Barbara Forrester – sitting with two magistrates – made the terms concurrent.
This resulted in Brierley’s jail term being halved.
