
A MAN accused of possessing a firearm with intent to cause his elderly parents to fear that violence would be used against them has appeared in court.
Brian John Capstick, 49, was charged by police following a late night incident at a property in the Bootle area of South Cumbria on December 13.
Capstick, of Newfield House, Ecclefechan, Dumfries and Galloway, appeared at Carlisle Crown Court earlier today (MON).
During a half-hour hearing over a video link from custody, Capstick pleaded not guilty to one charge.
This alleges that, on December 13, Capstick had in his possession a firearm with intent to cause his parents, 74-year-old James and Susan Capstick, “to believe that violence would be used against them”.
A timetable for the progression of the case was outlined by by Gerard Rogerson, for the prosecution.
Capstick, sporting greying hair and stubble, and wearing a dark-coloured jumper while appearing over a video link from custody accompanied by a prison officer, was represented by barrister Brendan Burke.
A crown court trial was listed to start on April 14. It is estimated this would last around two days.
Capstick was remanded in custody in the meantime, and told by Judge Peter Davies that his case would be mentioned again at the court on March 2.
