Former Barrow defender Yoan Zouma is to face prosecution over the notorious incident which involved his brother Kurt kicking a cat.
The 23-year-old younger brother of the West Ham defender filmed him slapping and kicking his pet at home.
The RSPCA says it has started proceedings against both brothers for their roles in the disturbing incident.
Yoan Zouma played four games for Barrow last season and had signed for Dagenham and Redbridge but had only played six times for the National League side.
Since the video appeared, the RSPCA removed two cats from Kurt’s home and began liaising with Essex Police about the incident.
Kurt continued to play for West Ham despite the controversy but Yoan was immediately suspended by his club.
An RSPCA spokesman said: “Following a full and thorough investigation, we have started the process of bringing a prosecution against Kurt Zouma and Yoan Zouma under the Animal Welfare Act.
“The two cats continue to be cared for by the RSPCA. We will be in a position to release more information once a court date is confirmed.”
West Ham say they fined their player the maximum amount possible and the fee was to be donated to animal welfare charities.
National League club Dagenham and Redbridge have not picked Yoan since January 29, but he will now return to the squad.
A club statement said: “Any further suspension from the team would be detrimental to both the club and Yoan.
“A decision has been made therefore for Yoan to be available to play.
“The club reserves the right to take further action if deemed necessary after the conclusion of the court proceedings.”
