
A moped rider, over the drink-drive limit, crashed through the windscreen of a car containing two young children.
Brian Orr, 50, came to the attention of a man on Inkerman Terrace in Whitehaven who was travelling with his partner and daughters at around 6.40pm on October 24 last year.
Orr was in control of a moped and was seen to drift into the car driver’s lane.
Prosecutor Brendan Burke told Carlisle Crown Court today: “The defendant continued to drift into his lane and did eventually drive into collision.”
Orr was thrown through the windscreen. This caused injury to the driver, who was initially feared to have suffered an elbow fracture, although that proved not to be the case and he was treated with a splint and painkillers.
“He and his partner, and in particular his two-year-old and five-year-old daughters were shaken up by the entire incident,” said Mr Burke.
When a sample of blood taken from Orr was later analysed, it showed 131 micrograms of alcohol — above the 80mcg legal limit.
Orr was said to be lightly convicted and had not been in any trouble since the 1990s, the court heard. He admitted dangerous driving and also drink-driving.
Judge Simon Medland QC suspended a four-month prison sentence for 12 months. Orr, of Sneckyeat Grove, Whitehaven, must compete 100 hours’ unpaid work and an electronically monitored night time curfew which runs until June 20.
He was also banned from driving for 12 months and must pass an extended retest.
