
A bid to appeal over a ruling by the High Court to throw out a challenge by a campaign group has been thrown out.
Transport Action Network brought its initial legal challenge against the Government’s approval of the £1.5 billion scheme to dual the A66.
It said the dualling would significantly increase carbon emissions but the High Court ruled it was not an arguable basis to claim the Government was in the wrong.
Transport Action Network asked to appeal the ruling, but today, the Court of Appeal has dismissed that request.
National Highways said: “This means we can continue to develop the scheme, to bring about critical improvements to the route, connecting communities, supporting businesses, and enabling freight traffic to access major ports such as Hull, Felixstowe, Stranraer and wider.
“Utility diversions, archaeological excavations, and surveys are underway, while we continue to develop the main part of the scheme, including the detailed designs.
The project remains part of the government’s ongoing spending review, and we await the outcome later in the year.”
