
A north Cumbrian drink-driver has had extra time added to his motoring ban after he behaved aggressively with police and initially refused to take a breath test.
Police received a 999 call at around 9.15am on November 18, reporting a Volkswagen Caddy panel van being driven erratically on Houghton Road, on the outskirts of Carlisle.
The vehicle was seen by officers and 37-year-old Daniel Kerr was identified as the driver and there was a passenger in the vehicle. Kerr appeared heavily intoxicated and refused on multiple occasions to take a breath test.
He was handcuffed due to his aggression, smacked his head off a desk while in custody and had to be inserted into a cell.
Kerr did calm down and provided an evidential sample which showed 46 micrograms of alcohol in 100 millilitres of breath. The legal driving limit is 35mcg.
Kerr, of Stanley Road, Brampton, pleaded guilty to driving with excess alcohol when he appeared at Carlisle Magistrates’ Court today.
The court heard Kerr was a man of previous good character and a professional driver for two decades who was poised to lose his job as a result of the conviction.
Magistrates imposed a £120 fine and extended a driving disqualification from 12 to 14 months, due to his behaviour towards police.
Kerr was offered a place on a drink-drive rehabilitation course which, if completed within a specified period, will reduce the ban by 14 weeks.
