A Penrith man has appeared in court accused of vowing to burn down a town takeaway, and threatening him with an imitation firearm.

Blake Stuart, 31, faces three charges which arise out of an incident which took place on Sunday, April 12.

One charge alleges that Stuart, of Stricklandgate, threatened to damage or destroy property; specifically that he would burn down a takeaway shop belonging to him.

A second charge alleges witness intimidation. Court papers show Stuart is alleged to have done so by threatening the same man with an imitation firearm, believing he was a potential witness in proceedings; and by making a threat to burn down his shop.

A third charge alleges the possession of an imitation firearm with intent to cause a second man to believe that unlawful violence would be used against him.

No pleas were entered by Stuart to any of the charges when he appeared at Carlisle Magistrates’ Court.

The case was sent to Carlisle Crown Court. Stuart is due to appear in front of a judge for a plea and trial preparation hearing on May 15.

In the meantime he has been remanded in custody.
